Dwayne Davis files motion to dismiss
Dwayne “Keef D” Davis, who is accused of murdering Tupac Shakur, has submitted a motion to dismiss the case against him.
Details of the motion and accusations
According to Associated Press, Davis’ attorney, Carl Arnold, filed the motion, asserting that his client’s rights were violated due to a 27-year delay in prosecution and the failure to uphold previous immunity agreements that federal and local authorities had granted Davis after he acknowledged his involvement in the 2008 murder.
In a press release, Arnold stated, “The prosecution has failed to justify a ten-year delay that has caused irreversible damage to my client. Moreover, failure to comply with immunity agreements undermines the integrity of the criminal justice system and compromises this prosecution.”
As of now, Davis’ trial is still set to begin on March 17th. Associated Press Prosecutor Mark DiGiacomo stated that the evidence against Davis is strong. Nonetheless, Davis has previously entered a not guilty plea to an open murder charge with a deadly weapon and gang enhancement, claiming that his earlier statements regarding Tupac’s shooting were merely “entertainment.”
Davis was arrested in September 2023 on suspicions of involvement in the murder of rap legend Shakur. He was taken into custody by Las Vegas police on Sept. 29, two months after they searched his wife’s home, where documents suggested they were looking for items “relating to the murder of Tupac Shakur.”
A former member of the Compton Crips gang, Davis pleaded not guilty on Nov. 2. He was already known to investigators prior to his arrest and had previously indicated that he was inside the Cadillac from which Shakur was shot. His arrest represented a significant development in a case that remained unresolved for 27 years.
